Rise in Family Court self representation

It was revealed at the end of last month (May) that there has been an increase of almost 50 percent in the number of parents going through the courts for custody of their children who aren’t receiving legal advice.

According to results of a survey of 500 justices, 46 percent of people seen in private courts are now representing themselves; with magistrates suggesting that this could be leading to a negative impact on cases, due to an increase in delays.

Magistrates have also raised concerns that in cases where one parent is representing themselves and the other is receiving legal representation there is a risk of potential unfairness.

The rise in parents representing themselves in family courts follows changes to the legal aid provision, which came into force in April 2013 and mean that fewer people are now eligible for financial support via the family court proceedings.
